Surrogacy refers to a contract in which a woman agrees to carry a pregnancy for another couple. Surrogacy Cost in India depends on various factors including its success rates, and infrastructure of the clinic, the experience of the doctor and other factors as well. There is no specific amount that states surrogacy cost as it includes numerous other costs depending on the intended parent and medical situation of the surrogate mother. Though Lok Sabha has passed the Surrogacy bill on 19 December 2018 and the bill states some rules to control Surrogacy in India. Lok Sabha has completely banned the Commercial surrogacy, only altruistic surrogacy is allowed in India.
The average cost of surrogacy in India ranges between Rs. 11,82,700 and Rs. 16,38,500 including diagnostics, disposables, medicine, and pregnancy delivery charges. This is the estimation for non-commercial surrogacy that doesn't include surrogate’s compensation.
Yet with the introduction of the new law on surrogacy in the country for altruistic surrogacy, the total cost of surrogacy may now depend on certain factors like In Vitro Fertilization, additional procedures such as ICSI, TESA, Donor sperm or eggs and some miscellaneous expenses on surrogate mother and surrogacy centres in India. Surrogacy Regulation Bill 2016 was given the green flag by Union Cabinet so did Assisted Reproductive Technology (ART) Regulation Bill 2017. India has been a favorite country for those who want to have their baby with surrogacy because of its cheapest cost compared to other countries before it was banned.
Note - Surrogacy is also known as Third-Party Reproduction, in which DNA or gestation is provided by a third party or donor other than the intended parents who will raise the resulting child.
The major factors on which the cost of surrogacy in India is dependent are:
1. Surrogate Mother Compensation: Although, Commercial surrogacy is banned in India Altruistic Surrogacy is still in practice. In an altruistic surrogacy, a surrogate mother doesn't accept any kind of monetary compensation. However, the intended parents pay for other miscellaneous expenses like maternity clothes, travel allowances to the physician’s office, necessary medication and housekeeping if required. Altruism also ignores the physical and emotional labor of a surrogate mother and does not take into account mental or physical postpartum problems.
2. Insurance: Some cost of surrogacy treatment in India is also paid for maternity health insurance coverage. This cost depends on whether the surrogate mother already owns health insurance or not.
3. IVF and Egg Fertilization Cost: The cost of surrogacy treatment also depends on the In Vitro Fertilization (IVF) process. As in this process, the eggs are retrieved from the donor or the intended mother and are fertilized by a donor or intended father’s sperm in the laboratory. This results in the embryo formation; thus the formed embryo is then implanted into the uterus of the surrogate mother. The cost of egg fertilization process ranges from Rs. 50,000 to Rs. 60,000.
4. Egg Donor Program: When the intended mother’s eggs are not healthy enough to create embryos, in this case, there will be a need for an egg donor. For this purpose, a donor is compensated for her time and effort. Based on these, the cost of surrogacy in India is far less as compared to other countries.
5. Legal Cost: To make sure that all the procedures are by the law, legal fees will be an essential component. Earlier, the fees of surrogacy including the cost of a frozen embryo and donor eggs used to be around Rs. 13, 06,000 excluding the cost of drafting and executing contracts. However, the legal cost of surrogacy in India varies from place to place and depends on many other factors as well.
6. Travel Allowances of Surrogate Mother: Travel allowances include the charges of money spent on the traveling of a surrogate mother, as it may be hard to visit the clinic if the surrogate mother belongs to a remote area. So the total cost of surrogacy in India will also include the amount of money spent on travel by the surrogate mother.
